OpenAI Countersues Elon Musk Over Alleged “Bad-Faith Tactics”

The ongoing legal battle between OpenAI and its co-founder Elon Musk has taken a new turn, with OpenAI filing a countersuit against Musk, accusing him of employing “bad-faith tactics” to hinder the company’s progress and seize control of its AI innovations.

As the legal battle intensifies, industry experts suggest that the dispute is less about AI ethics and more about control and monetization.

Musk, who co-founded OpenAI but left the organization in 2018, has been vocal about his concerns regarding its shift from a non-profit to a for-profit entity. He previously sued OpenAI CEO Sam Altman, alleging that the company had strayed from its original mission to develop AI for the benefit of humanity.

In response, OpenAI has now countersued, claiming that Musk has engaged in disruptive actions, including spreading false information, making frivolous legal claims, and submitting a takeover bid that OpenAI describes as a “sham”. The company argues that Musk’s actions are aimed at slowing down OpenAI’s advancements and gaining control over its cutting-edge AI technology.

The lawsuit, filed in the US District Court for the Northern District of California, seeks to prevent Musk from continuing what OpenAI describes as unlawful interference in its operations. The case is expected to go to trial in **March 2026**, with both sides preparing for a high-stakes legal showdown.

Musk’s AI company, xAI, has emerged as a competitor to OpenAI, though it has yet to match OpenAI’s influence in the AI sector. Last month, Musk’s xAI acquired his social media platform X (formerly Twitter), further fueling speculation about his ambitions in the AI space.

“This is about control. This is about revenue. It’s basically about one person saying, ‘I want control of that start-up,'” said Ari Lightman, a professor at Carnegie Mellon University.
